The Third Appeals Circuit for Family Disputes at the Hawalli Court, presided over by Judge Kamel Al-Omari, ruled to overturn the "first instance" judgment and appointed a citizen as the guardian of her children, removing the Public Authority for Minors Affairs from their guardianship.
The case details that the Public Authority for Minors Affairs assumed guardianship over the minor children of a citizen following his death. Due to the Authority's failure to fulfill its responsibilities in managing their assets, collecting debts owed to their deceased parent from various entities, and not taking necessary steps for the company inheriting from the deceased to continue its activities, the deceased's wife filed a lawsuit against the Authority before the first instance court, which issued the now-overturned ruling.
Lawyer Abdulhamid Al-Sarraf's office appealed this ruling, arguing that it violated the law, misapplied it, and suffered from a lack of reasoning and corrupt reasoning.
The appeal emphasized that the mother is the most dedicated caretaker for her children and that she had exerted efforts to protect their assets that the Authority failed to provide. The appeal presented evidence that the Authority had breached its duties. Consequently, the court decided to grant the appellant's requests, appointing her as the guardian of her children and removing the Authority from their guardianship.
